1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern the use of water damage restoration services provided by Water Damage Restoration Bellevue WA (“Company,” “we,” “us,” or “our”), located at 15700 Bel-Red Rd, Bellevue, WA 98008, WA Contractor License #NATIORC792M6.

By requesting our services by phone, email, or any other method, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree with any part of these Terms, do not engage our services.

Emergency situations: When you call for emergency water damage response, verbal authorization at the time of the call constitutes acceptance of these Terms for the purposes of that emergency dispatch.

2. Services

We provide the following water damage restoration services in Bellevue, WA and surrounding areas:

  • Emergency water extraction and removal
  • Structural drying per IICRC S500 Standard
  • Mold remediation per IICRC S520 Standard
  • Sewage cleanup (Category 3 biohazard)
  • Crawl space water damage restoration
  • Condo and HOA water damage documentation
  • Fire and water damage restoration (IICRC FSRT)
  • Insurance claim documentation and Xactimate estimation

All services are performed by IICRC-certified technicians. Our certifications include WRT (Water Restoration Technician), ASD (Applied Structural Drying), S520 (Mold Remediation), and FSRT (Fire & Smoke Restoration Technician).

We reserve the right to decline services at our discretion, including situations where conditions present safety risks to our technicians or where scope exceeds our licensed capabilities. In such cases, we will refer you to appropriate resources.

3. Payment Terms

Insurance-covered work: For water damage events covered by homeowners insurance, we bill your carrier directly. You are responsible for any deductible amount specified in your policy. We accept all major insurance carriers including State Farm, Safeco, Allstate, Farmers, and USAA.

Non-insurance work: For work not covered by insurance or for uninsured customers, payment terms will be specified in your written estimate. We accept payment by:

  • Check
  • ACH bank transfer
  • Major credit cards (Visa, Mastercard, Discover)
  • Financing options available — ask for details

Invoicing: Invoices are due within 30 days of completion unless otherwise agreed in writing. Overdue accounts accrue interest at 1.5% per month (18% annually) as permitted under Washington State law.

Deductibles: Your insurance deductible is your responsibility. We do not waive, absorb, or discount deductibles. Deductible waiver arrangements are prohibited under Washington State insurance law.

4. Insurance Claims

When we assist with insurance claim documentation, the following terms apply:

  • Call us first: Under Washington State duty-to-mitigate law (RCW 48.01.030), you are required to take reasonable steps to prevent further damage. Calling us immediately fulfills this obligation.
  • Xactimate documentation: We prepare Xactimate estimates at prevailing King County WA-SEA market rates. These are submitted to your carrier on your behalf.
  • Carrier disputes: If your insurance carrier disputes our scope or pricing, we will work with you and your carrier to resolve the dispute. We are not responsible for final claim settlement decisions made by your insurer.
  • Supplemental claims: Hidden damage discovered during restoration may require supplemental documentation. We will notify you before proceeding with any work that increases the scope.
  • Bad faith: Washington State RCW 48.30.015 provides remedies including triple damages for unreasonable claim denial. We can refer you to a public adjuster or attorney if your claim is denied in bad faith.

Not legal or insurance advice: Our assistance with insurance documentation is a service convenience, not legal or insurance advice. For disputes exceeding $10,000, we recommend consulting a licensed public adjuster or attorney.

5. Warranties and Representations

Our warranties:

  • Work performed by our technicians is warranted against defects in workmanship for 12 months from the date of completion
  • All drying work meets or exceeds IICRC S500 Standard for Professional Water Damage Restoration
  • All mold remediation meets or exceeds IICRC S520 Standard
  • We carry commercial general liability insurance and workers’ compensation as required by Washington State

Warranty exclusions — our warranty does not cover:

  • Damage caused by recurring water intrusion after our work is complete (e.g., ongoing roof leak, unfixed plumbing)
  • Pre-existing damage or conditions present before our services began
  • Mold recurrence caused by moisture sources we were not engaged to address
  • Normal wear and deterioration following restoration
  • Damage caused by your failure to maintain completed restoration work

6. Limitation of Liability

To the maximum extent permitted by Washington State law:

  • Our total liability for any claim arising from our services is limited to the amount you paid us for the specific work giving rise to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages including lost business income, loss of use, or third-party property damage not directly caused by our negligence
  • We are not liable for pre-existing structural conditions, concealed defects, or code violations discovered during restoration
  • We are not liable for decisions made by your insurance carrier regarding coverage or settlement amounts

Nothing in these Terms limits our liability for personal injury or death caused by our negligence, or for any other liability that cannot be excluded under Washington State law.

7. Your Obligations

By engaging our services, you agree to:

  • Provide accurate information: Accurately describe the water damage, source, and property conditions when requesting service
  • Property access: Provide safe and reasonable access to your property for our technicians and equipment during the agreed service period
  • Hazard disclosure: Disclose known hazards on the property (asbestos, lead paint, structural instability, aggressive animals, weapons)
  • Power and utilities: Ensure electrical power and water access are available for equipment operation unless we mutually agree otherwise
  • Insurance cooperation: Cooperate with your insurer in the claim process; we are not responsible for delays caused by your failure to respond to carrier requests
  • Timely payment: Pay all amounts due within the agreed payment terms
  • Do not alter work: Do not remove, modify, or interfere with drying equipment or completed work without our written authorization

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington without regard to conflict of law principles.

Dispute resolution process:

  • Step 1 — Direct resolution: Contact us directly at (425) 920-1919 or [email protected]. Most disputes are resolved at this step within 5 business days.
  • Step 2 — Mediation: If direct resolution fails, either party may request mediation through the King County Dispute Resolution Center before proceeding to litigation.
  • Step 3 — Litigation: Any unresolved disputes shall be brought exclusively in the courts of King County, Washington. You waive any objection to jurisdiction or venue in King County.

Washington Contractor Licensing: You may also file a complaint with the Washington State Department of Labor and Industries (lni.wa.gov) regarding contractor licensing matters.
